1. Agreement to Terms

Welcome to BlogFlow SDK. These Terms of Service ("Terms") constitute a legally binding agreement between you and Ausdata Science Pty Ltd ("we", "our", or "Company"). By accessing or using the BlogFlow SDK and related services ("Services"), you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

2. Service Description

BlogFlow SDK is a TypeScript SDK that provides a lightweight, high-performance client for BlogFlow API Server v2 with the following key features:

  • Server-side search functionality
  • Next.js ISR (Incremental Static Regeneration) caching support
  • React Hooks (useBlogPosts, useBlogPost, useBlogSearch)
  • Multilingual support (7 languages)
  • Built-in themes and automatic style injection
  • TypeScript type safety
  • SSR (Server-Side Rendering) ready

3. Account and Registration

To use certain features of the Services, you may need to create an account and provide accurate, up-to-date information. You are responsible for:

  • Maintaining the accuracy and completeness of account information
  • Protecting the confidentiality of your account credentials and API keys
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree to use the Services only in a lawful manner and in compliance with all applicable laws and regulations, including but not limited to:

4.1 Prohibited Activities

You must not:

  • Violate any applicable laws, regulations, or third-party rights
  • Use the Services for any illegal, harmful, fraudulent, or malicious activities
  • Attempt to gain unauthorized access to the Services, other accounts, or systems
  • Interfere with or disrupt the normal operation of the Services
  • Transmit any viruses, malicious code, or other harmful technologies
  • Reverse engineer, decompile, or disassemble any part of the Services
  • Exceed reasonable usage limits, including but not limited to excessive API calls

5. Intellectual Property

The Services and all content, including but not limited to text, graphics, logos, icons, images, software code, themes, styles, and documentation, are protected by copyright, trademark, and other intellectual property laws.

5.1 SDK License

BlogFlow SDK is released under the MIT License. You may use, modify, and distribute the SDK subject to the terms of the MIT License.

5.2 User Content

You retain all rights to any content you submit, post, or display through the Services. By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, copy, modify, and distribute such content solely for providing and improving the Services.

6. Payment and Billing

Certain features of the Services may require paid subscriptions. You agree to:

  • Pay all applicable fees, which are displayed at the time of purchase
  • Provide accurate and complete payment information
  • Authorize us to charge your designated payment method
  • Understand that all fees are in Australian Dollars (AUD) unless otherwise stated

Subscriptions will automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time.

7. Service Availability

We strive to ensure high availability of the Services but do not guarantee that the Services will always be available, uninterrupted, or error-free. Services may be temporarily unavailable due to maintenance, updates, technical failures, or other reasons. We are not liable for any service interruptions or data loss.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Services are provided "as is" and "as available" without any express or implied warranties
  • We do not warrant the accuracy, completeness, timeliness, or suitability of the Services
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the total fees paid by you to us in the relevant 12-month period

This limitation does not apply to warranties or liabilities that cannot be excluded under the Australian Consumer Law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ausdata Science Pty Ltd and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the Services for:

  • Violation of these Terms
  • Fraud, abuse, or illegal activity
  • Extended periods of inactivity
  • Legal requirements

You may also terminate at any time by deleting your account or ceasing to use the Services. Upon termination, your right to access the Services will immediately cease, but we may retain certain information to comply with legal obligations.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved first through good faith negotiation. If negotiation fails, disputes shall be submitted to the courts of New South Wales with appropriate jurisdiction.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or service notifications. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
